POUND PLUNGE CONTEST RULES & REGULATIONS
In consideration of acceptance of this entry, I hereby waive any and all claims for myself and my heirs against Great Plains Regional Medical Center, KELN – Mix 97 One, KOOQ – ESPN Radio, KNPQ – Q-Country, the Platte River Mall and any and all sponsors and each of their agents, servants, officers and employees, for injury or illness which may directly or indirectly result from my participation, and I further agree to save and hold said parties harmless and agree to indemnify eash of said persons against all liability for any loss, cost injury or damage to persons or property which may arise by virtue of the undersigned in the Pound Plunge. I further state that I am in proper condition to participate in this event.
I agree and consent to the use of photographs and interviews to be used for publicity and advertising of the Pound Plunge, and I will waive all claims for such use.
I agree and consent to all the rules and regulations listed below.
- No purchase necessary.
- Participant must be at least fourteen years of age or older. If between the ages of fourteen and seventeen, the participant must be on a parent or guardian's team with signed permission from the parent and/or guardian.
- Participants must sign up in teams of two persons.
- The Pound Plunge Contest begins with the first weigh-in at the Platte River Mall on Tuesday, January 12, 2010.
- The Pound Plunge will last for 12 weeks. Participants must keep the routine schedule for 12 weeks, beginning January 12, 2010 through March 30, 2010.
- After the last weigh-in on March 30, 2010, winners will be announced.
- A winning team will be determined by the highest percentage of weight lost. The tie-breaker (if necessary) will be placed in a random drawing. Prizes include, but are not limited to exercise equipment, gym memberships, bikes and other prizes.
- Cash will not be awarded in lieu of a prize. Prizes cannot be exchanged or sold.
- Participants must sign a waiver releasing Great Plains Regional Medical Center, Eagle Communications, Inc. dba KELN – Mix 97 One, KOOQ – ESPN Radio, and KNPQ – Q-Country, and the Platte River Mall from any liability prior to participating in a workout schedule and before starting the Pound Plunge Contest.
- Listeners will be updated on the progress of the contestants each Friday morning on the Fudge For Breakfast Morning Show on KELN – Mix 97 One, as well as updates on the website, www.mix97one.com.
- Participants may quit at any time, and if they do, will automatically disqualify themselves for any prizes.
- Participants must weigh in at least 9 out of the 12 weeks at the weekly weigh-ins during the designated times at the Platte River Mall. All weigh-ins will be conducted on a scale provided by Great Plains Regional Medical Center. Failure to abide will lead to disqualification.
- Teams must be registered by January 19, 2010 to be eligible for prizes.
- Any participant who was awarded First, Second or Third Team or Top Man or Top Woman in the 2009 Pound Plunge Contest may participate in the 2010 Pound Plunge, but are not eligible to win First, Second or Third Place Team or Top Man or Top Woman prizes in the 2010 Pound Plunge Contest. Other winners must allow thirty days to pass before they or anyone in their household wins again unless otherwise noted in the contest rules of other station contests.
- Great Plains Regional Medical Center, the Platte River Mall, Eagle Communications, Inc, or any other potential sponsors do not warrant any of the products, materials or services that a participant receives. The materials, services or products that a participant receives are provided 'as is.' There may be warranties provided by the manufacturer of the product, material or service for which Great Plains Regional Medical Center, the Platte River Mall, or Eagle Communications Inc have no responsibilty or duty to perform.
- Great Plains Regional Medical Center, the Platte River Mall or Eagle Communications Inc are not responsible if the prize awarded becomes unavailable due to any reason beyond their control.
- The Pound Plunge Contest is open to listeners residing in the KELN-FM, KOOQ-AM and KNPQ-FM listening area.
- All employees, agents, successors, interns or assignees of Eagle Communications, Inc., employees of other radio or television stations and members of their immediate families or members of their households are ineligble.
- Participants must be U.S. Residents.
- By participating, the participants and winners grant KELN – Mix 97 One permission to use their names, characters, photographs, voices and likenesses in connection with the Pound Plunge Contest, via print, broadcast or other forms of media, and waive any claims to royalties, rights, compensation or renumeration for such use.
- By accepting a prize, the participant/winner agrees to release and hold sponsors harmless from any and all losses, danages, rights, claims and actions of any kind resulting from acceptance, possession or use of any prize including without limitation personal injuries, death, acts of God and property damage.
- By participating in the Pound Plunge Contest, participants agree to be bound by all the official rules of this promotion.
- All claims are subjects to verification by Eagle Communications, Inc., whose decision is final.
- Winners may be taxed on the total value of their prize package. All federal, state and local tax laws apply. Any federal, state and/or local taxes are the sole responsibility of the winner. A 1099 Form will be sent to all prize winners that win a prize or prizes (cumulative) valued over $599 within the calendar year. Each winner is the sole responsible party for reporting and paying any and all applicable Federal, State, Local and other taxes. Each winner must provide Eagle Communications with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. Failure to timely provide such information and/or any other reasonably required documentation, including without limitation, a release and affidavit of eligibility, may result in delay in receiving prizes or the forfeiture therof. Prizes are not transferable or redeemable for cash.
- Participants must use their true legal name when participating in contests or claiming prizes, and may not win any contest under an assumed name. Winners may be disqualified and prizes forfeited if they are found participating under an assumed name or alias.
- Eagle Communications, Inc. reserves the right to modify contest rules and/or dates at any time without additional notice.
- Eagle Communications reserves the right to substitute prizes of equal or greater value.
- Prizes must be picked up at Eagle Communications, Inc. at 1301 East Fourth Street, North Platte, Nebraska, unless otherwise stated, within thirty days of winning the prize. Prizes not picked up within thirty days will be forfeited. Proof of identiy must be presented when picking up a prize.
- The Pound Plunge Rules and Top Results are available for inspection at Eagle Communications, Inc. Business Office, Monday through Friday, 8:00 am to 5:00 pm, or by sending a self-addressed envelope to Mix 97 One Contest Rules, PO Box 248, North Platte, Nebraska 69103.
Contest participants on their own behalf and on behalf of their heirs, successors, representatives and/or assigns hereby fully and forever remises, releases and discharges Great Plains Regional Medical Center, The Platte River Mall and Eagle Communications, Inc., dba KELN – Mix 97 One, KOOQ – ESPN Radio, and KNPQ-FM – Q-Country, and each and all of it's subsidiary and affiliated corporations, companies and divisions, its predecessors, successors and assigns and its respective directors, stockholders, officers, employees and agents of and from any and all claims, demands, agreements, contracts, covenants, actions, suits, causes of action, obligations, controversies, debts, costs, expenses, accounts, damages, judgements, losses and liabilities of whatsoever kind or nature in law, equity or otherwise, whether knows or unknown, whether or not concealed or hidden which against it or any of it they have had or now have or which any of their heirs, representatives and assigns hereafter can, shall or may have for or by reason of any matter, cause or thing whatsoever including but not in any respect limiting the generality of the foregoing any and all claims which or might have asserted related to this contest. Specifically, the participant intends to release Great Plains Regional Medical Center, the Platte River Mall, and Eagle Communications, Inc. dba KELN – Mix 97 One, KOOQ – ESPN Radio and KNPQ – Q Country Radio, and each and all of its subsidiary and affiliated corporations, companies and divisions, its predeccessors, successors and assigns and its respective directors, stockholders, officers, employees and agents from any liablity.
